1. Introduction

Welcome toTrendSight ('we,' 'our,' or 'us'). By using our services, you agree to these Terms & Conditions ('Terms'). Please read them carefully.

 

2. Services Provided (Including Data Use and AI Insights)

We provide services that allow you to integrate various third-party accounts (such as Google SSO, Google Ads, and Merchant Center) to gather campaign and performance data. This data is processed to provide AI-driven insights and recommendations, which are offered for informational purposes only. No guarantees are made regarding the accuracy or effectiveness of these insights, and we are not liable for any decisions you make based on the AI-driven recommendations.

 

3. Limited User Licensing

By using our service, you are granted a limited, non-exclusive, non-transferable license to use the platform strictly for its intended purposes. You may not modify, reverse-engineer, or otherwise misuse the platform in any unauthorized way.

4. User Account and Integration Permissions

By connecting your accounts, you grant us permission to collect and process the specified data for purposes of analyzing trends and generating insights. You may revoke access at any time; however, we reserve the right to retain data for up to 5 years after revocation for the purpose of improving our AI model. Users agree that revocation does not affect our right to use data already collected.

 

5. Data Collection and Retention (Including 5-Year Retention Post-Revocation)

We collect campaign and performance data from integrated accounts. Personal Identifiable Information (PII) is not collected. Data retained after account disconnection will be anonymized and used solely to improve the AI model, with retention lasting no longer than 5 years.

 

6. User Responsibilities and Limitations

Users agree not to misuse the platform, including but not limited to reverse engineering, unauthorized access, or attempts to manipulate the AI model or data processing systems. Violation of these terms may result in immediate suspension or termination of access.

 

7. Disclaimer of Warranties and Limitation of Liability

Our service is provided 'as is' and without warranties of any kind, whether express or implied. To the maximum extent permitted by law, we disclaim all warranties, including but not limited to fitness for a particular purpose. Our liability will be capped at the amount you have paid for the service, or $100, whichever is lower.

 

8. Indemnification

You agree to indemnify, defend, and hold harmless TrendSight from any and all claims, damages, or liabilities arising from your use of the service, including attorney fees.

 

9. Binding Arbitration and Dispute Resolution

Any dispute will be resolved through binding arbitration, waiving your right to a trial in court. However, we strive to resolve disputes informally first.

 

10. Service Availability and Future Fees

This service is provided for free 'as is.' We do not guarantee uninterrupted service and reserve the right to introduce fees in the future.

 

11. Prohibited Uses

Unauthorized use of the platform, including reverse engineering or illegal activities, will result in termination of your account.

 

12. Age Restrictions

The service is intended for users 18 years or older, or those legally capable of entering into contracts.

 

13. Data Security and Disclaimer

We take reasonable steps to protect your data but disclaim liability for any breaches or unauthorized access.

 

14. Privacy and Data Processing

We collect and process data to improve our AI model. By using the service, you consent to this processing.

 

15. Modifications to the Terms

We reserve the right to modify these Terms at any time. Continued use after changes implies acceptance.

 

16. Limitation of Action

Any claim must be filed within one (1) year after the cause of action arose.

We are not liable for performance failures due to causes beyond our control, such as natural disasters or strikes.

 

18. Data Ownership

You retain ownership of data you upload, but we retain ownership of aggregated, anonymized data for improving our AI model.

 

19. No Third-Party Beneficiaries

These Terms are solely between you and TrendSight, with no third-party beneficiaries.

 

20. Non-Assignment Clause

You may not assign your rights under these Terms to any third party without our written consent.

 

21. Termination of Service

We reserve the right to terminate or suspend your account if you violate these Terms.

 

22. Class Action Waiver

You agree to resolve disputes on an individual basis and waive any right to participate in class actions or mass arbitrations.

 

23. Waiver of Liability for Third-Party Services

We are not liable for any issues or damages caused by third-party platforms integrated with our service (e.g., Google Ads, Merchant Center).

 

24. Intellectual Property Protection

All intellectual property related to the platform, including software, AI models, and algorithms, remains the exclusive property of TrendSight. Users may not copy, distribute, or claim ownership of any part of the platform.

Provisions related to indemnification, limitation of liability, and data usage rights shall survive termination or expiration of the user's account.

 

26. Governing Law and Jurisdiction

These Terms shall be governed by the laws of the State of Connecticut, and any legal proceedings must be brought in the courts located within Connecticut.

 

27. User Representations and Warranties

Users represent that they have the right to share data through the platform and that their use of the service does not violate any agreements with third parties.

 

28. Entire Agreement Clause

These Terms constitute the entire agreement between you and TrendSight, superseding any prior agreements or understandings.

 

29. Disclaimer for AI Output Risks

AI-generated insights may involve risks and uncertainties. Users are responsible for independently verifying the recommendations before acting on them.

 

30. Fees and Refunds

If fees are introduced in the future, they will be non-refundable, unless otherwise specified.

 

31. Termination for Convenience

We reserve the right to terminate or suspend user accounts at our discretion, with or without cause.

 

32. Consent to Communications

By using the service, you consent to receiving electronic communications from us, including updates and changes to the platform.
